1. General
These Terms and Conditions govern all sales, deliveries, and use of the Hard Rock Aggregates website. Hard Rock Aggregates reserves the right to update these terms at any time without prior notice. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
If you are placing an order on behalf of a business, you represent and warrant that you have the authority to bind that business to these terms.
2. Products & Pricing
All aggregate materials listed on the Site are subject to availability. Prices are listed per ton and are subject to change without notice. Quoted prices are valid for 30 days from the date of the quote unless otherwise stated in writing.
Minimum order quantities may apply depending on material type and delivery location. Please contact us for current minimums.
3. Orders & Payment
Orders may be placed by phone, email, or through the Site's contact form. An order is confirmed only upon receipt of written acknowledgment from Hard Rock Aggregates.
Payment is due prior to delivery unless a credit account has been established. We accept major credit cards, ACH transfers, and approved purchase orders. A late payment fee of 1.5% per month may apply to overdue balances.
4. Delivery
Delivery dates and times are estimated and not guaranteed. Hard Rock Aggregates shall not be liable for delays caused by weather, road conditions, equipment breakdowns, or other circumstances beyond our control.
It is the customer's responsibility to ensure safe and legal access to the delivery site. Damage to private roads, driveways, or property resulting from delivery is the responsibility of the customer.
The customer must be present or designate a responsible party to direct material placement. If no one is available, the driver will make a reasonable placement decision and the delivery will be considered complete.
5. Returns & Cancellations
Due to the bulk nature of aggregate materials, all sales are final once material has been loaded or delivered. Cancellations made at least 24 hours before scheduled delivery may be cancelled without penalty.
In the event of an error in material type or quantity caused by Hard Rock Aggregates, we will make reasonable efforts to correct the issue at no additional cost to the customer.
6. Limitation of Liability
Hard Rock Aggregates' liability for any claim arising from a sale or delivery shall not exceed the price paid for the specific order at issue. We are not liable for indirect, incidental, or consequential damages of any kind.
Material specifications are provided in good faith based on standard industry testing. The customer is responsible for verifying that selected materials meet their project requirements.
7. Governing Law
These Terms and Conditions are governed by the laws of the state in which Hard Rock Aggregates operates, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.
